Advice on Making a Will

None of us like to think about our own death but it's an unfortunate fact that, unless you plan now by making a will, your loved ones are likely to be left with a substantial inheritance tax burden to add to their grief.

You may resist the idea of making a Will because of superstition or because you feel that its morbid. You may even believe that, when the inevitable happens, your relatives will take care of things.

Don't let the Government benefit...

If you die intestate (i.e. without making a Will), your assets including your money, your property and all your possessions will be dealt with according to legal rules - known as intestacy rules - in a way that you might not want and given to people that you might not want to benefit.

Furthermore, if you have no relatives and have not made a Will, the Government becomes your sole beneficiary and is entitled to the proceeds of your entire estate!

In theory, there is no need to use a Solicitor when making a will and, indeed, many people think it's better (and cheaper) to buy a DIY will using will-writing software.

DIY Wills are designed to deal with the simplest of provision. However, it's important to remember that, even with simple provision in your Will, there are many rules and regulations that you may not have taken into account and that can open up a whole raft of legal problems for your family.

According to the Law Society, a badly prepared Will (or a Will that's out of date) is often worse than having no Will at all!

  • not including all the assets of your estate, causing a partial intestacy;

  • failure to substitute beneficiaries;

  • failure to take into account dependants, for whom a claim can arise after your death;
